Deputation (Duty) Allowance to Central Government Employees - Recommendations of the 7th Pay Commission - DOPT Orders

OFFICE MEMORANDUM

Subject:- Grant of Deputation (Duty) Allowance - Recommendations of the Seventh Central Pay Commission - Regarding.


This Department’s OM No. 6/8/2009-Estt.(Pay-II) dated 17.6.2010 inter-alia provides for rates of Deputation (Duty) Allowance admissible to Central Government employees.


2. As provided in para 7 of Ministry of Finance, Department of Expenditure’s Resolution No.1-2/2016-IC dated 25th July, 2016, the matter regarding allowances (except Dearness Allowance) based on the recommendations of the 7th Central Pay Commission (CPC) was referred to a Committee under the Chairmanship of Finance Secretary and until a final decision thereon, all Allowances have been paid at the existing rates in the existing pay structure.


3. The decision of the Government on various allowances based on the recommendations of the 7th CPC and in the light of the recommendations of the Committee under the Chairmanship of the Finance Secretary has since been issued as per the Resolution No.11-1/2016-IC dated 6th July 2017 of Department of Expenditure.


4. As mentioned at Sl.No.46 of the Appendix-II of the said Resolution dated 6th July 2017, the recommendation of the 7th CPC for enhancement of ceiling of Deputation (Duty) Allowance for civilians by 2.25 times has been accepted and this decision is effective from 1st July, 2017. Accordingly, the President is pleased to decide that the rates of Deputation (Duty) Allowance and certain other conditions relating to grant of Deputation (Duty) Allowance shall be as under:-


The Deputation (Duty) Allowance admissible shall be at the following rates:


(a) In case of deputation within the same station the Deputation (Duty) Allowance will be payable at the rate of 5% of basic pay subject to a maximum of Rs.4500 p.m.


(b) In case of deputation involving change of station, the Deputation (Duty) Allowance will be payable at the rate of 10% of the basic pay subject to a maximum of Rs.9000 p.m.


(c) The ceilings will further rise by 25 percent each time Dearness Allowance increases by 50 percent.


(d) Basic Pay, from time to time, plus Deputation (Duty) Allowance shall not exceed the basic pay in the apex level i.e. Rs. 2,25,000/-. In the case of Government servants receiving Non Practising Allowance, their basic pay plus Non-Practising Allowance plus Deputation (Duty) Allowance shall not exceed the average of basic pay of the revised scale applicable to the Apex Level and the Level of the Cabinet Secretary i.e. Rs.2,37,500/-.


Note: 1 ‘Basic pay’ in the revised pay structure (the pay structure based on 7th Central Pay Commission recommendations) means the pay drawn by the deputationist, from time to time, in the prescribed Level, in Pay Matrix, of the post held by him substantively in the parent cadre, but does not include any other type of pay like personal pay, etc.


Note: 2 In cases where the basic pay in parent cadre has been upgraded on account of non-functional upgradation (NFU), Modified Assured Career Progression Scheme (MACP), Non Functional Selection Grade (NFSG), etc., the upgraded basic pay under such upgradations shall not be taken into account for the purpose of Deputation (Duty) Allowance.


Note 3 In the case of a Proforma Promotion under Next Below Rule (NBR): If such a Proforma Promotion is in a Level of the Pay Matrix which is higher than that of the ex-cadre post, the basic pay under such Proforma Promotion shall not be taken into account for the purpose of Deputation (Duty) Allowance. However, if such a Proforma Promotion under NBR is in a Level of the pay matrix which is equal to or below that of the ex-cadre post, Deputation (Duty) Allowance shall be admissible on the basic pay of the parent cadre post allowed under the proforma promotion, if opted by the deputationist.


Note 4 In case of Reverse Foreign Service, if the appointment is made to post whose pay structure and/ or Dearness Allowance (DA) pattern is dissimilar to that in the parent organisation, the option for electing to draw the basic pay in the parent cadre [alongwith the Deputation (Duty) Allowance thereon and the personal pay, if any] will not be available to such employee.


Note: 5 The term ‘same station’ for the purpose will be determined with reference to the station where the person was on duty before proceeding on deputation.


Note: 6 Where there is no change in the headquarters with reference to the last post held, the transfer should be treated as within the same station and when there is change in headquarters it would be treated as not in the same station. So far as places falling within the same urban agglomeration of the old headquarters are concerned, they would be treated as transfer within the same station.


5. Para 6.1 of this Department’s OM No.6/8/2009-Estt(Pay-II) dated 17.6.2010 stands amended to the above effect.


6. In so far as persons serving in the Indian Audit & Accounts Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.


7. These orders shall take effect from 1st July, 2017

Employee joined with fake Caste Certificates to be dismissed – DOPT Order

Subject: Compilation of information about appointments made on the basis of fake/ false caste certificates and follow up action taken thereon – regarding 


This Department have been 3 receiving references from various Ministries/ Departments regarding appointments made on the basis of fake/ false caste certificates despite the instructions contained in the Department’s OM. No. 11012/1/91-Estt.(A) dated 19.05.1993, which have been re-iterated vide OM. No. 3601 1/1/2012 Estt.(Res.) dated 10.01.2013. The instructions provide that if it is found that a Government servant had furnished false information or produced a false certificate in order to secure appointment, he should not be retained in service. Thus when an appointing authority comes to know that an employee had submitted a false/ fake caste certificate, it has to initiate action to remove or dismiss such an employee from service as per the provisions of relevant Service Rules.

2. It has been decided to collect information from all the Ministries /Departments about appointments made on the basis of fake/ false caste certificates and follow up action taken thereon. Therefore, all the Ministries /Departments are requested to collect information from all Organisations under their administrative control about the cases where the candidates got/ alleged to have got appointment against vacancies reserved for Scheduled Castes, Scheduled Tribes and Other Backward Classes on the basis of false/ fake caste certificate and send a consolidated report in this regard in the enclosed Proforma to this Department by 15.07.2017 positively.

Backlog Vacancies : DOPT Minister Reply in Lok Sabha

As per information provided by 10 major Ministries/Departments including Public Sector Banks/Financial Institutions, Central Public Sector Undertakings etc., 28,713 vacancies remained unfilled as on 31.12.2016, which comes to about 31% of 92,589 backlog vacancies reserved for Scheduled Castes (SCs), Scheduled Tribes (STs) and Other Backward Classes (OBCs).

The Government had constituted a Committee under the Chairmanship of the then Secretary, Department of Social Justice and Empowerment to make an analysis of the reasons for non-filling up of reserved vacancies and to suggest remedial measures. Based on the recommendations of this Committee, Department of Personnel and Training issued instructions in November/December, 2014 to all Ministries/Departments to constitute in-house Committee to identify backlog reserved vacancies, study of the root cause of backlog reserved vacancies, initiation of measures to remove such factors and to fill up the backlog reserved vacancies.


Various Ministries/Departments have constituted in-house committee and initiated action for filling up of reserved vacancies.

Department of Personnel and Training monitors the progress in filling up of reserved category vacancies for Scheduled Castes, Scheduled Tribes and Other Backward Classes with 10 Ministries/Departments having majority of the employees in Central Government. Six meetings were held in this regard.

The total number of backlog reserved category vacancies is 28,713 in respect of those 10 Ministries/Departments.

As per information provided by those 10 Ministries/Departments, 20,975 vacancies for Scheduled Castes, 15,874 vacancies for Scheduled Tribes and 27,027 vacancies for Other Backward Classes have been filled up during the period 01.04.2012 to 31.12.2016.

These 10 Ministries/Departments have been requested to take expeditious action with regard to the unfilled reserved backlog vacancies.

This was stated by the Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office Dr. Jitendra Singh in a written reply to a question by Shrimati Neelam Sonker and Shri Dushyant Chautala in the Lok Sabha today.

Central Civil Services (Leave) Amendment Rules, 2017 with respect to sexual harassment

G.S.R. 251(E).—In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely:-
1. (1) These rules may be called the Central Civil Services (Leave) Amendment Rules, 2017.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil Services (Leave) Rules, 1972, for rule 48, the following rule shall be substituted, namely:-
” 48, Special Leave connected to inquiry of sexual harassment – Leave upto a period of 90 days may be granted to an aggrieved female Government Servant on the recommendation of the Internal Committee or the Local Committee, as the case may be, during the pendency of inquiry under the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 and the leave granted to the aggrieved female Government Servant under this rule shall not be debited against the leave account”.

The undersigned is directed to say that it has been proposed to amend the CCS(CC&A) Rules 1965 by introducing stringent timelines for completing Disciplinary proceedings in a time bound manner. The proposed draft Notification for amending CCS (CCA) Rules, 1965 is enclosed herewith. Before framing the Rules, all stakeholders, Ministries / Departments are requested to offer their comments/views, if any, in this regard at the e-mail address poulose.ev13.nic.in latest by 21st March, 2017.

Admissibility of Deputation (Duty) Allowance while on deputation

Subject: Admissibility of Deputation (Duty) Allowance while on deputation – regarding.

The undersigned is directed to refer to this Department’s O.M. of even number dated 17th February 2016 vide which powers were delegated to Ministries / Departments / borrowing organisations to extend deputation tenures up to a period not exceeding 7 years at a stretch, in respect of cases covered by the O.M. dated 17th June 2010.
2. The matter regarding the admissibility of Deputation (Duty) Allowance in view of the change in maximum number of years of deputation tenure as provided above has been examined in this Department.
3. As per Para 8.3.2 of the OM No. 6/8/2009-Estt.(Pay-II) dated 17th June 2010, where the extension is granted up to the fifth year, the official concerned will continue to be allowed Deputation (Duty) Allowance, if he/she has opted to draw deputation (duty) allowance.
4. This Department’s O.M. No. 2/6/2016-Estt.(Pay-II) dated 17th February 2016 delegates powers to Ministries / Departments / borrowing organisations, to extend deputation tenures up to a period of 7 years in a stretch, in respect of cases covered by the O.M. dated 17th June 2010. However, there has been no modification of the Para 8.3.2. of the O.M. dated 17th June 2010 by the O.M. dated 17th February 2016. The new O.M. dated 17th February 2016 provides vide Para 4 that all other terms and conditions issued vide OM No. 6/8/2009-Estt.(Pay-II) dated 17th June 2010 will remain unchanged.
5. Thus, admissibility of Deputation (Duty) Allowance would be only as per Para 8.3.2 of the O.M. dated 17th June 2010, i.e. only up to the fifth year, if the deputationist has opted to draw Deputation (Duty) Allowance.

2. The administration of cadre(s) of the Organized Services of the Union is done based upon the provisions as contained in the Service Rules(s). The policy change(s) in terms of financial up-gradation, grant of promotion, composition of various Committee(s) for promotion, qualifying service in various grades, are brought for the benefit of the members of the Service. It has been observed by DoPT that several recommendations of Pay Commission have not been incorporated in the Service Rules.(Copy of OM is enclosed).
3. In this regard, I am directed to request all the Pr.CCITs(CCA)/Pr.DGITs to undertake revision of Service Rules of Organised Services under their administrative control. I am further directed to request all the Pr.CCITs(CCA)/Pr.DGITs to indicate the time frame by which they would revise the Service Rules of organised Services under their administrative control.

Abolition of 85% posts in the grade of LDC

Subject: Abolition of 85% post falling vacant meant for direct recruitment in the grade of JSA(erstwhile LDC)-reg.
In pursuance of DoP&T’s O.M. No. 9/2/2003-CS-ll dated 20th April, 2005, it was decided to abolish 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment quota in the grade of JSA (erstwhile LDC) of CSCS. The said decision was taken by the Cabinet after considering the recommendations of the report of First Cadre Restructuring of CSS.
2. However, it is observed that though a number of the cadre units have achieved the target of abolition of 85% of the posts falling vacant on or after 03-10-2003 meant for direct recruitment in the grade of JSA(erstwhile LDC) of CSCS every year. Some cadre units as shown in Annexure still have to achieve the target.
3. The Ministries/Departments shown in the Annexure are requested to take necessary action to abolish the remaining posts immediately and furnish a compliance report to DoP&T by 13th May, 2016 along-with a copy of the Office Order of the number of posts abolished. The deadline may please be strictly adhered to.
