Brief of National Anomaly Committee Meeting held on 11-1-2018

issues raised by the Staff Side in the National Anomaly Committee Meeting

1.The JCM Forum both at the National Level and Departmental Level has become in effective and the meetings are not taking place as per the JCM Scheme due to this issues are remaining unresolved. Therefore the JCM Forum may be activated and meetings may be held regularly.

2.The Departments under the Government are arbitrarily taking decisions with regard to closure, out sourcing, displacement Of manpower in the name Of surplus etc without even discussing with Recognized Federations. Example of Defence Ministry and Ministry of Urban Affairs (Printing Press) etc are quoted. Necessary instructions may be issued to all the Departments to take the Staff Side in to confidence before taking any such decisions.

3.The Staff Side has demanded for extension of the date for switching over to 7th CPC from a date on which the employee got promotion / MACP. Instruction is not yet issued on this matter. The same may be expedited.

4.The report Of NPS Committee is not given to the Staff Side. The same may be given to the Staff Side and a meeting may also please be held with the Staff Side to discuss about the recommendation of the Committee before Govt. takes any decision.

5) The assurance given by the Ministers with regard to review of minimum pay and fitment factor has not been implemented and the issue needs to be seriously addressed by the Govt.

Responding to the above points the Chairman assured that the points raised by the Staff Side is noted and the concerned authorities may be informed. He further assured that the meeting of the Standing Committee and the National Council JCM would take place shortly.

Staff side  have already informed us that the DOPT has rejected 11 items proposed by the Staff Side on the plea that those items are not falling within the definition of Anomaly. Thereafter the Staff Side vide letter dated 14.12.2017 has once again resubmitted the items justifying Our position. Discussion took place today on those 11 items. After discussion the following decision were taken : –

1.Anomaly in computation of Minimum wage

After listening to the arguments put forth by the Staff Side the Chairman assured that the matter may be reconsidered for accepting this agenda as an Anomaly

2. 3% Increment in all Stages

will be discussed in the Standing Committee meeting

3. Remove Anomaly due to index rationalisation:

This will be discussed in the Standing Committee meeting

4.Minimum Pension

Since this is a demand of the Staff Side the same cannot be discussed in the National Anomaly Committee

5. Date of Effect of Allowances -HRA, Transport Allowance, CEA etc

This will be discussed in the Standing Committee meeting

6. Anomaly in the grant of DA instt. wef 1.1.2016 :

This will be further studied

7. Implement the recommendation on Parity in Pay Scale between Sr. Auditor/ Sr. Accountant Of IA&AD and organized Accounts with Assistant of Section Officer of CSS

A Committee Of DOPT is studying the matter. The Staff Side may wait for the decision of the Committee

8. Technical Supervisors of Railways:

To be discussed in the Railway Departmental Anomaly Committee

9. Anomaly in the assignment of replacement Of Levels Of pay in the Ministry of Defence, Railways, Mines etc in the case of Store Keepers

To be discussed in the Departmental Anomaly Committee of Ministry of Defence

10. Anomaly arising from the decision to reject option-I in pension fixation

This issue has to be dealt separately by the Staff Side

11. Parity in Pay Scales between Assistants ‘Stenographers in field/ Offices and Assistant Section Officer and Stenographers in CSS

This issue would be considered after receipt of additional information from the Staff Side.
The next meeting of the National Anomaly Committee would be convened shortly

7th Pay Commission – If Government fails to hikeAllowances from April 1, they will invite agitation of Employees, says NJCA Chief.

7th Pay Commission news – Although April 1 was considered to be the tentative date for increasing the allowances of central government employees, the Finance Ministry is yet to send out an indication in this regard.

The committee on allowances, headed by Finance Secretary Ashok Lavasa, is yet to submit its report to the government. The National Joint Council of Action (NJCA), which has been negotiating with the Centre over the 7th Pay Commission report, is expected to launch an agitation if the allowances are not hiked from April 1.
“If the government fails to implement the hike in allowances from April 1, then they will invite the agitation of employees,” said NJCA convenor Shiv Gopal Mishra while speaking to India.com. “The committee on allowances should have submitted its report by now. We don’t know why it has been delayed for so long,” Mishra added.

The veteran unionist also demanded the government to provide arrears to the central government employees from the date of implementation. Sounding a pessimistic tone, Mishra said, “Arrears are unlikely. But protests are most likely if they hike the allowances without providing the employees with arrears. This is our genuine demand. The total amount pending from January 1, 2016 should be given to the employees.”
Earlier in the week, Centre hiked the Dearness Allowance (DA) for central government employees. DA was increased to 2 per cent. However, the unions were disappointed with the hike. “We were expecting a hike of at least 3 per cent. This matter would be raised in the meeting of National Council,” Mishra added.
The 7th Pay Commission report implemented in July last year increased only the basic component of the salaries of the employees. Due to the anomalies raised by employee unions, Centre had deferred the hike, tasking Finance Secretary to review the recommendation of Justice (retd) AK Mathur-led 7th Pay panel.

The Lavasa committee was scheduled to submit its report in November. However, the Finance Ministry provided it an extension of three months. In February, Model Code of Conduct was imposed due to the five-state assembly elections underway.
Although, the committee was expected to submit its report immediately following the conclusion of assembly elections, no development has been reported so far. While answering a query in the Lok sabha, MoS Finance Arjun Singh Meghwal confirmed that committee on allowances is yet to submit its report to the Centre.

NJCA chief Shiv Gopal Mishra confirmed that the allowances report would be submitted on Wednesday.

New Delhi, Feb 21: Committee on allowances, headed by Finance Secretary Ashok Lavasa, will submit its report tomorrow, claims National Joint Council of Action (NJCA) convenor Shiv Gopal Mishra. Central government employees were expecting the report to be tabled by Monday. However, the committee delayed the submission due to unspecified reasons. The report would pave the way for the implementation of hiked allowances as per the revised 7th Pay Commission recommendations.

“Government has made no announcement yet. But the report by Committee on allowances would be tabled tomorrow,” Shiv Gopal Mishra said, while speaking exclusively to India.com. On being asked whether the government would make an announcement in relation to the arrears on allowances, he replied, “Let us see what comes out of the report. We are expecting the hike in allowances, as per our demands. We have to wait and see whether the government makes an announcement on arrears as well.”

The committee on allowances was formed in July 2016, after central government employees raised several anomalies related to the 7th Pay Commission report submitted by Justice (retd) AK Mathur. The 7CPC report had recommended the abolition of 51 existing allowances, and subsumption of 37 others of the total 191 allowances.

The major point of grievance was the reduction in Housing Rent Allowance (HRA) offered to central government employees. As per the 6th Pay Commission report, the HRAs provided were 30 per cent, 20 per cent, 10 per cent for employees living in ‘X’, ‘Y’, ‘Z’ category towns/cities. However, the 7th Pay Commission report decreased the allowances to 24, 16 and 8 per cent of the basic pay.

Reduction in HRA has irked a major section of central government employees, who reside in rented accommodations. A section of the aggrieved employees have blamed the top bureaucracy for the delay in HRA hike. “Naturally, the common central government employees are more affected by the delay in allowance hike. The top bureacrats don’t take higher allowances, therefore, they are not interested in the hike,” Mishra said.

Apart from the hike in allowances, central government employees have also demanded Centre to provide arrears on the allowances. Since the date of implementation of 7th Pay Commission was fixed as January 1, 2016, employees have demanded the release of arrears on allowances as well.

Although the government provided arrears on basic pay while hiking the salaries on July 1, indications have been made that no arrears would be released on allowances. NJCA has confirmed that the employee unions would launch protest across the nation if the allowances are hiked, without the arrears. “Arrears are unlikely, but protests would be launched if they fail to release (the arrears),” Mishra said.

The date of allowances hike is reported to be April 1. NJCA claims, through its sources, that the government would be implementing the allowance hike from April 1. “It is most likely that the government announces the hike by April 1,” Mishra confirmed.

Dear Sir,
This is in continuation of the discussions, the Staff Side had with you on 1st September, 2016. We send herewith brief notes on the allowances, which are required to be retained or wherever the quantum has to be enhanced.
As presented before the Committee, we have dealt with the subject in the following manner:-
(i) General Allowances, which are of general nature, covering the Central Government employees across the Departments.(10)
(ii) Area Specific Allowances – The allowances which are granted to all Central Government employees who are posted to a particular location.(2)
(iii) Department Specific Allowances which are granted to a section of the employees in a Department/Ministry taking into account the special nature of jobs assigned to them. (4)
We have received the notes from the Postal, Defence and Railway Organisations. We have requested the Associations/Federations of other departments to send us the notes in the matter. We hope to receive the same soon. As and when the same is received, it will be submitted.
We have endorsed a copy of this letter to the Joint Secretary (Implementation Cell). We have also asked the Departmental Associations to submit their notes on the Department Specific Allowances to the Implementation Cell as also to their Heads of Departments. We request you to kindly convene the meeting of the Committee to discuss the allowances on which Notes are presented to you through this letter.

Sub: Brief of the meeting held today between the Government of India and the National Council (JCM) (Staff Side)
The Government of India has constituted a committee, under the Chairmanship of Addl. Secretary(Exp.) with J.S.(Pers.), JS(Estt.) and JS(Imp.) as members, to deal with the pending issues of our memorandum, submitted to the Empowered Committee, of which prominent are “Minimum Wage and Multiplying Factor”.
The first meeting of the said committee with the National Council(JCM) Staff Side was held today, i.e. 30th August, 2016, which remained almost introductory. Apart from the Official Side members, Shri M. Raghaviah, Shri M.S. Raja and I myself(from the Staff Side JCM) attended the said meeting.
We raised vehemently the issues of “Minimum Wage and Multiplying Formula” and made them very clear that; the VII CPC has accepted Dr. Aykroyd Formula for fixing Minimum Wage, but has not implemented the said formula in full sense, so, that is not acceptable to the Staff Side(JCM), therefore, Minimum Wage from Rs.18000 must be enhanced and accordingly Fitment Formula should also be changed.
It was agreed by the committee that, since we are again meeting on 1st September, 2016 with the Committee on Allowances, the next meeting of the said committee will be fixed in consultation with the Staff Side(JCM).
Thereafter, we also met the Cabinet Secretary(Government of India) and there also we shown our anguish about the inordinate delay in resolving those issues which were agreed to. The Cabinet Secretary said that, orders for the gratuity have been issued for the NPS covered employees, and orders for the PLB and arrears have also been issued. Many of the issues raised by the Staff Side(JCM) have been accepted and implemented and the remaining issues would also be pursued and settled.

Dear Friends!

            On the call of the National Joint Council of Action(NJCA), on hopeless recommendations of VII CPC, scrapping of National Pension System (NPS) and other long pending genuine demands of the Central Government Employees, covering lakhs and lakhs of Railwaymen, Defence (Civilian) personnel, Postal employees, working in different Central Government offices throughout the country, unitedly not only participated and contributed regularly in agitational programmes of different stages of struggle but also succeeded to reflect such an environment in the entire length and breadth of the country well before the date of commencement of nationwide “Indefinite Strike” from 11th July, 2016; that compelled the Government of India to think better than Rs.18,000 as Minimum Wage, change in theFitment Formula and many other important heartburning aspects, like National Pension System (NPS) and to handover all such issues to the committees with a commitment to consider the same within a timeframe of four months. Considering positive attitude of the senior ministers of the Government of India, the National Joint Council of Action (NJCA) had decided to give another four months time to the government.

            I am fully aware that, our Central Government Employees and the youth with full sincerity and dedication had unitedly created an unprecedented environment throughout the country, enlightening all the fellowmen about our demands in support of “Indefinite Strike”continuously, for which they deserve to be thanked a lot.

            Earlier too I had drawn your attention and warned to be aware of such elements who will confuse and mislead you by various baseless arguments and try to weaken and derail our united struggle.

            I know that, such negative thinking persons neither would have participated in the strike nor moved shoulder to shoulder in the movement of struggle. Negative thoughts not only weaken the individual, but also malign mental attitude of the others. Certain such persons, pouring in forcefully their polluted views on others, only try to break the broader unity of the movement. After all, it is not a new phenomena, such elements were found in all the strikes of the past. But nowadays; propaganda scenario has changed. Earlier, social media – WhatsApp, Facebook etc. were not available, so, such elements were launching propanganda campaign in the Canteens, Pan shops etc. In the present era, instead of using social media, WhatsApp, Facebook etc, in positive way for uniting co-workers, such elements unsuccessfully attempt to break the unity with their contaminated thought, reflecting the fellowmen that they are the only genius and ever alert and real friends of them, but such individuals always deceived and show their back at the climax of the struggle.

            I had earlier mentioned; to be very careful of such vindictive personalities who have destructive thought during the struggle, meant to secure their own rights. It is waste to have even least hope of any contribution in any struggle from such individuals who during agitation/strike try to side-away themselves by all means.

            For complete preparation of strong background in any movement, struggle/strike, role of an individual unit, branch, division, zonal and national level, strong change can never be devaluated, and such an strong united movement at all levels leaders ultimately encourages to give a clarion call of struggle at the national level. National leadership has to take care of all even-odd circumstances, lead his attitude, patience and safety of their force. Deep contemplation yields of the movement for him to cause execution to implement various strategies and timelines for the fulfillment of the objective of the obligation to go beyond such a positive approach rather than criticism for decisions on the subtleties of the churning the movement extended to the middle of your peers and get validness struggling peace succeeds.

            I have full faith that, all the Central Government Employees were ready, already even today and will remain ready with the time slot to fight for their rights.

            I again remind my colleagues to be aware and give befitting reply to those having negative thinking, and a strong movement only can go ahead.

Sub: Revision of Pension
This issue of acceptance of Option-I (or) II was discussed with your good self at the residence of Hon’ble Home Minister (Government of India), Wherein Hon’ble Minister for Railways and Hon’ble MOSR were present, by the Staff Side National Council (JCM). You had categorically agreed on our demand that, no dilution would be made in the options given to the Pensioners by the VII CPC. It is unfortunate that, a rider, “subject to feasibility”, has been imposed in Option-I.
Sir, this is very unfair and we will appreciate if you kindly get the sentence “subject to feasibility” removed from that para to keep your promise also. It should be left to the Pensioners that whatsoever option they want to choose, they should be allowed to Opt. The argument of non-availability of record is misleading and should not be given any cognizance because PPOs of the Pensioners are the base record and is available with the organizations concerned.
We earnestly seek your urgent intervention in this regard to avoid unnecessary hardship to millions of Pensioners.

NJCA UNANIMOUSLY RESOLVES TO DEFER THE INDEFINITE STRIKE.



After the meeting with the Home Minister today by the NJCA and further developments leading to issue of a Press Release by the Government of India assuring consideration of the issues raised by the Staff Side relating to the pay scales and other recommendations of the Pay Commission by a High Level Committee. The NJCA has decided to defer the Indefinite Strike in the background of meetings with the Ministers and the assurance by the Government of India.
The Press Release by the Government today is reproduced below:

Government assures Representatives of Unions representing employees of the Central Government that the issues raised by them relating to the pay scales and other recommendations of the 7th Pay Commission would be considered by a High Level Committee.
Representatives of Unions representing employees of the Central Government had met the Home Minister Shri Rajnath Singh, the Finance Minister Shri Arun Jaitley and the Minister for Railways Sh. Suresh Prabhu in the evening of 30th June, 2016. 
They had requested that certain issues raised by them in relation to the pay scales and other recommendations of the Pay Commission be allowed to be raised before a Committee of Secretaries looking into different aspects of grievances of employees in relation to the Pay Commission recommendations
The Ministers assured the Union leaders that the issues raised by them would be considered by a High Level Committee.

Latest development

The National Joint Council of Action (NJCA) met at the Staff Side office, JCM, New Delhi today at 11:30 AM as scheduled. During the discussions, the Convener received an invitation from the Honourable Home Minister, Shri Rajnath Singh. The following members of the NJCA met the Home Minister in a delegation.

The issues in the Charter of demands were discussed with special reference to the 7th CPC related demands. The delegation brought to the notice of the Honourable Home Minister that the NJCA has not received a communication from the Government over the assurances held out on 30th June, 2016, when the NJCA delegation met the Honourable Home Minister, Finance Minister and the Railway Ministers. On 30th June 2016, the Government had assured to refer the revision of Minimum wage and fitment formula to a Committee. The Finance Minister has also clarified that the Government has taken the decision to implement the recommendation of the 7th CPC to bring about parity between the past and present pensioners. They added that such a communication in confirmation of the assurances will enable them to take a decision over the strike action which is to commence from 11th July, 2016.

The Honourable Home Minister assured the delegation that the Government will honour the assurances held out to the NJCA leaders on 30th June, 2016 and accordingly the Honourable Finance Minister, Shri Arun Jaitly will issue a Press Statement today, with copy to NJCA.

After receipt of the copy of the Press Communique issued by the Honourable Finance Minister, the NJCA will take a final decision.

We are to inform you that the NJCA had a discussion with the Government of India yesterday, i.e.30.06.2016 over certain demands contained in our Charter of Demands. In the meeting, following ministers were present: -

we should go ahead with our preparations

As all of you are aware that the Union Cabinet has accepted the report of the VII CPC today.
It has been noticed that there is no improvement in Minimum Wage and Multiplying Factor as well, which was our hard pressed demand. Instead, wages, as recommended by the VII CPC have been accepted as it is, which is highly disappointing. Only two committees have been formed, one to take care of the allowances and another for National Pension Scheme, which will submit their reports within four months time.
It is quite unfortunate that, our demand for improvement in the report of the VII CPC has not been considered by the government.
Therefore, it would be quite appropriate that, we should go ahead with our preparations for “Indefinite Strike”, slated to be commended from 06:00 hrs. on 11th July, 2016.
You are also advised -to intensify the mass mobilization.
